DAMAGES. NO PROVISION IN THIS AGREEMENT SHALL BE TAKEN AS EXCLUDING OR RESTRICTING OR ATTEMPTING TO EXCLUDE OR RESTRICT ANY LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM THE NEGLIGENCE OF THE COMPANY.
6 ASSIGNMENT AND TERMINATION. The permissions granted to you under this Agreement are personal to you and may not be transferred or assigned, whether for any consideration or not.
7 GENERAL. This licence will be governed by the laws of England and Wales. For the benefit of The COMPANY, you, the Licensee, agree that the courts of England and Wales shall have exclusive jurisdiction to hear and determine any suit, action or proceeding which you may bring arising out of or in connection with this Agreement.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENCE AND UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS; YOU FURTHER AGREE THAT IT IS THE COMPLETE STATEMENT OF THE AGREEMENT BETWEEN US WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US, RELATING TO THE SUBJECT MATTER OF THIS LICENCE.
